INTRODUCTION

Midway Star is a registered limited liability company in the United Arab Emirates. Please carefully review these terms before submitting your service order. Placing an order on the site implies your immediate agreement to these Terms of Sale. By accessing our site www.midwaystars.com, you also agree to adhere to these terms and conditions and our “Privacy Policy.”
We reserve the right to modify these terms at any time by posting a new version on our website. These changes do not affect rights and obligations that arose prior to such changes.

ORDER ACCEPTANCE

Order Acceptance: We will notify you of our order acceptance in writing (e.g., by email or mobile messaging). If we are unable to accept your order, you will be informed in writing or through a call, and no charges will be applied.

Payment: By placing an order, you authorize us or our third-party payment processor to process your credit/debit card details. We accept payment by credit/debit card, via your wallet, or cash on delivery (not exceeding AED 2,500). For credit/debit card payments, we may need to create an account with our third-party payment processors.

Cancellation: You may cancel your order up to 1 hour before the scheduled service. We may cancel your order if payment is not made, required information is not provided, or delivery is not allowed.

DELIVERY OF YOUR ORDER

Delivery Costs: Displayed on our site. Delivery Date: Information available on our site. Delivery Delays: We will contact you in case of delays due to events beyond our control. If no one is available during delivery, we’ll provide rescheduling instructions.

Invoice: An electronic invoice will be sent to your provided email address.

Refund: For services not delivered, a full refund is available if you cancel before 2 hours of the scheduled service. Refund details depend on the payment method.

GENERAL

Property Access and Owner/Tenant Responsibility: A responsible person must enable access during scheduled work. Failure to do so may result in charges.
Cancellation of Scheduled PPM Appointments: Cancellation within 72 hours incurs charges.

Liability for Losses: We investigate suspected personal belongings interference but aren’t liable without evidence.

On-Line Prices: Standard prices are valid for areas on the Midway Star website.

Callout Response Times: Midway Star commits to response times but is not responsible for property damage during the time between callout request and arrival.

System/Equipment Malfunction: Midway Star investigates malfunctions attributable to its work. Customer approval is crucial for replacing recommended parts.

Limited Liability for Damage to Property/Assets: Midway Star’ liability is limited to the value of the works, up to AED 5,000.

Property Insurance: Customers are recommended to have property insurance.

Use of Scaffold or Electric Lifting Equipment and Safety Issues: Additional fees apply for scaffold/lifting equipment use.

Materials, Consumables, and Spare Parts: Charged at cost price plus 15%.

Provision of Incorrect Information by the Customer: Midway Star may revise charges based on incorrect information.

Condition of Property Systems when taking out a Contract: Corrective maintenance costs may apply.

Payment Agreements for One-Off Renovation Projects: Vary based on project value.

Changing a Contract: Changes possible after every fourth month.

Cancellation of a Contract by a Customer: 30 days’ notice required.

Contract Auto Renewal: Automatically renews for a year.

Cancellation of a Contract by Midway Star: Non-settlement may result in service suspension or discontinuation.

Excessive Non-Emergency Call Out Consumption: Additional callouts beyond limits are charged at a discounted rate.

Monthly/Quarterly Paying Customers: Specific terms for monthly paying customers.

Services to Customers for Expired Contracts: Emergency callouts provided for one week after contract expiry with confirmation of renewal intention.

Expiry of Contracts: Midway Star not responsible for assets after contract expiry.

Conversion to an Annual Contract: Non-contract callout cost credited to a new contract within 24 hours.

Changes to Services and Agreements: Changes notified via email.

Payment/Legal Terms: Payment methods and legal jurisdiction details.

This Contract is subject to the laws of the Dubai International Financial Centre (DIFC). Any dispute arising out of, or in connection with this Contract, including any question regarding its existence, validity, interpretation, or termination, shall be referred for amicable settlement by a nominated senior representative of each Party within ninety (90) days of a Party first giving notice of the dispute. If amicable settlement is not reached within such time period (or longer period agreed in writing by the Parties), it shall be referred to the exclusive jurisdiction of the Courts of the DIFC.
